Jones Soda wanted to put a lolcat on their clever soda bottles across the country. So we asked if we can run a contest to find that special lol. (It’s like American Idol, but we don’t has to listen to ur singing voice.)

- NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. GAME BEGINS ON MARCH 24, 2008 AND ENDS ON APRIL 18, 2008 (THE “ENTRY PERIOD”)
- ELIGIBILITY:
The ICHC Jones Lolcat Promotion is open to individuals who are legal residents of the 50 United States and the District of Columbia and Canada (except in the province of Quebec, where is void, and wherever else prohibited or restricted by law) Participants must be 13 years of age or older. Employees of Jones Soda (the “Sponsor”), ICHC (“Publisher”) and their respective parent companies, franchisees, partners, retailers, affiliates, subsidiaries, advertising and promotion agencies, printing suppliers and any other individual or company involved in the development or execution of the Promotion and the immediate families (spouse, parents, children, siblings, and their respective spouses) and household members of each such employees, are not eligible to play or win. This Promotion is subject to all applicable federal, state, provincial, and local laws and regulations. By participating, you agree to these Official Rules and to the decisions of the independent judges whose decisions are final and binding in all respects. Sponsor reserves the right to verify eligibility qualifications of the winners. - How to Participate:
Submit a lolcat photo to using the provided contest upload tool on ICHC. By submitting a photo the contestant warrants they own copyrights to the photo and that the photo does not infringe the copyright, trademark, patent, trade secret, right of privacy, right of publicity or other legal right of any third party, and (ii) complies with all applicable laws, rules, and regulations. Contestant further represent and warrants that: (i) there are no claims, demands or any form of litigation pending, or to the best of their knowledge, threatened with respect to any submitted photo; (ii) neither Sponsor or Publisher will be required to make any payments to any third party in connection with its use of submitted photo; (iii) the Contestant shall indemnigy and defend both the Sponsor and the Publisher against any such claims or costs. - Prize:
Top 5 finalists will receive a free case of MyJones and a Jones Soda T-Shirt
Grand Prize winner will have their photo printed on a national distribution bottle run of Jones Soda. - Drawing and Notification:
Top 5 Finalists will be selected, from among all eligible entries received by voting conducted by the ICHC members during the weeks of March 24 through April 14. The Grand Prize winner will be selected from the Top 5 Finalists by voting conducted by the ICHC members during the week of April 21, 2008. - List of winners will be published on both the Publisher and the Sponsor’s websites for a month following the drawing and will be available by written request after that period of time.
- Prize Conditions:
All taxes and expenses not specified here are the sole responsibilities of the winner. Prizes are non-transferable and; no prize substitutions are allowed. Winner will be required to complete and return (within 10 days of written notification) an Affidavit of Eligibility and Liability/Publicity Release. There seems to be a delay between votes and the Top Rated board. We’re looking to see how long the delay is with the voting widget provider.

The voting page is designed not to show ones you already saw to prevent ballot stuffing. Not that you’d do that.
It doesn’t allow you to vote more than once for a particular macro anyway. It seems like there’s a “loop” of only so many images, and as newer ones are being added, the older ones “drop out”. The reason I say that is because I have been able to look at a particular one more than once, but as the day progressed, those near the end of the “loop” would disappear completely. The other reason I think that’s the case is because the older macros vote totals all but come to a standstill after being posted for awhile. *shrug*
Question for you though…..since votes are gathered both by number of votes, and on the scale (1 to 5 cheezeburgers), how do you determine a winner? By number of votes, regardless of cb rating? Or is it more complicated?

More complicated. We use a third party to tally and rank the top-rated standings…
So, we can assume that means you have access to all of the voting information, and not just what is on display in the “Top Ranked” or “Hot” lists? Since they are woefully inaccurate, I’ve got to hope your judges are able to see everything and not just this list. Thanks again!

I agree, I think if there is any way ICHC can check the copyright on a certain picture that would be great. Otherwise ICHC could get into a ton of trouble. Using a picture in a way that is connected with something commercial, according to my understanding, could be jumped on in a way that pictures on the web for a non-commercial use might not be. I just don’t want ICHC to get in troubles.

iz my opinion that celebrities and politicians not be used because of endorsement issues and all that stoopy legal crap – even ordinary every day jane and john public citizen must first sign release before their pictures can be used.
